Welcome to Cabo Eletro. The terms "we", "our" and "Cabo Eletro" refer to Cabo Eletro Comercial LTDA, which operates this store and this website, including all related information, content, features, tools, products and services, with the goal of offering you, the customer, a shopping experience for electrical materials and industrial automation (the "Services").

These Terms and Conditions of Use and Purchase ("Terms"), together with the other policies referenced herein (such as the Return Policy and the Privacy Policy), describe your rights and responsibilities when using the Services. Please read this document carefully, as it contains important information about your rights, warranties and limitations of liability.

By accessing, interacting with, or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, we recommend that you do not use or access the Services.

1. Acceptance of the terms

By accessing this website, creating an account, requesting a quote or making a purchase, you declare that you have read and agreed to these Terms. If you do not agree, we recommend that you do not use the services offered by Cabo Eletro.

By agreeing to these Terms, you declare that you are at least of legal age in your state or country of residence, or that you have the authorization and legal supervision of a guardian to use the Services.

2. Purpose

Cabo Eletro sells electrical materials, industrial automation components and maintenance items (MRO), operating in the B2B and B2C model, with online sales, list quotes, and direct service by email and WhatsApp.

3. Access and registration

To use the Services, including browsing the store, requesting quotes or purchasing products, you may be asked for information such as name, email, billing, payment and delivery details.

The customer is responsible for the accuracy and updating of the information provided in the registration, quote or order. For invoicing by CNPJ (company tax ID), company documents may be requested (CNPJ, legal name and state registration).

You are solely responsible for keeping your access credentials secure and for all activity carried out in your account. You may not transfer, sell or assign your account to third parties.

4. Products, descriptions and availability

• Images are for illustration purposes; the item shipped corresponds to the description and code stated in the listing.
• The condition of each item (new, used or refurbished) is indicated in the product description. The description will also state whether the item is supplied in the manufacturer's box or not. It is up to the customer to check this information in the listing before purchasing.
• Items marked as "on request" depend on confirmation of availability and lead time before the sale.
• Cabo Eletro is not an authorized distributor or representative of the brands sold; all brands belong to their respective owners.

We do our best to represent products accurately. Even so, colors and appearance may vary depending on the type of device, screen settings and resolution used to access the store.

Product descriptions may be changed at any time, without prior notice, at our discretion. We reserve the right to discontinue any product and to limit the quantities offered to any person, region or specific case.

5. Quotes and list orders

Quotes sent by email or WhatsApp are informational and have limited validity, and may vary according to stock availability and commercial conditions. Order confirmation occurs after acceptance of the conditions and payment.

6. Orders

When placing an order, you submit a purchase offer. Cabo Eletro reserves the right to accept or refuse any order at its discretion. The order is only considered accepted after confirmation by Cabo Eletro and processing of the payment.

Review your order carefully before finalizing it, as it may not be possible to fulfill cancellation requests after acceptance. If we do not accept, change or cancel an order, we will try to notify you through the contacts (email, phone or address) provided at the time of purchase.

Your purchases are subject to exchange or return exclusively in accordance with our Return Policy.

7. Prices, taxes and payment

Prices are charged in Brazilian Reais (BRL) and may be changed without prior notice; the amount in effect at the time the order is finalized applies. Any USD amount displayed on an English product page is a non-binding visual estimate converted from the BRL list price and does not change the price, discounts, currency or final amount shown at checkout. Unless expressly stated, published prices do not include taxes, shipping and other applicable charges, which will be informed at order checkout.

We accept Pix, bank slip (boleto), credit cards and digital wallets. In resale sales, Tax Substitution (ST) may apply, the responsibility of the buyer when due.

Promotions may have their own rules. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion prevail.

By providing payment details, you declare that: (i) the information is true, correct and complete; (ii) you are authorized to use the payment method provided; and (iii) you will bear the amounts due for the published prices, including shipping and applicable taxes.

8. Delivery and lead times

Items in stock are dispatched within 1 business day after payment confirmation. Transport times depend on the carrier and the destination region, and are informed at order checkout or in the quote.

Delivery times are estimates and may vary. Delays attributable to the carrier, to logistics processing, or to events beyond our control are not the responsibility of Cabo Eletro. From the delivery of the products to the carrier, responsibility for the risk of loss or damage in transit follows the applicable legislation and the terms of the contracted shipping method.

9. Right of withdrawal, exchanges and returns

In purchases made outside the physical establishment, the individual consumer may exercise the right of withdrawal within 7 (seven) calendar days from receipt, under the terms of article 49 of the Consumer Protection Code. Other exchanges and returns, including for international orders, follow our Return Policy.

10. Warranty

Products carry the legal warranty provided by the Consumer Protection Code for domestic sales. Any additional manufacturer warranties, when they exist, are stated in the item description.

11. Customer responsibilities

The customer is responsible for verifying the technical suitability of the item for their application. Our team can assist in validating the code and specification, but the final purchase decision and correct installation are the responsibility of the buyer and a qualified professional.

12. Optional tools

You may have access to third-party tools as part of the Services, which we do not monitor or control.

These tools are provided "as is" and "as available", without warranties of any kind and without any endorsement on our part. The use of these tools is your sole responsibility, and you must know and agree to the terms of the respective third-party provider.

New features eventually made available will also be subject to these Terms.

13. Third-party links

The Services may contain materials and links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of these materials, and we are not liable for any damages related to access to these sites or to the purchase of products and services from third parties.

We recommend reading the policies and practices of each third party before any transaction. Complaints, questions or issues about third-party products and services should be directed to the respective third party.

14. Relationship with the platform and payment methods

The store is operated with the support of Shopify and integrated technology and payment providers, which enable part of the services. Sales and purchases, however, are made directly with Cabo Eletro.

By using the Services, you acknowledge that these third-party platforms are not responsible for any aspect of the purchase-and-sale relationship between you and Cabo Eletro, subject to the rights ensured by the applicable consumer legislation.

15. Intellectual property

The content of this website (texts, layout, displays, images, graphics, product reviews, video, audio, the Cabo Eletro brand and other visual elements, as well as their selection and arrangement) is protected by copyright and other intellectual property rules.

These Terms allow the use of the Services only for personal and non-commercial purposes related to your purchase relationship. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, store or transmit any material from the Services without our prior written consent.

Third-party names, trademarks and logos are the property of their respective owners and are used only to identify the products sold.

16. Comments and user-submitted content

If you submit ideas, suggestions, reviews, proposals or any other content ("Comments"), you grant Cabo Eletro a free, worldwide and sublicensable license to use, reproduce, modify, publish and display that content in any medium, including for commercial purposes, subject to applicable law.

You declare that: (i) you own or hold the necessary rights to the submitted content; (ii) you have disclosed any compensation received for the submission; and (iii) the content complies with these Terms. We have no obligation to keep confidentiality, compensate, or respond to such Comments.

We may, without obligation, monitor, edit or remove content that we consider, at our discretion, unlawful, offensive, defamatory, obscene, or that violates third-party rights or these Terms. You are solely responsible for the content you submit and for its accuracy, and you agree not to use a false address, impersonate another person, or insert viruses or malicious code.

17. Privacy and data protection

The processing of personal data follows the General Data Protection Law (LGPD - Law No. 13,709/2018). For details on collection, use and the data subject's rights, see our Privacy Policy.

The information you submit to the Services may be transmitted and processed by the technology and payment platforms that support the operation, exclusively for the provision of the Services.

18. Errors, inaccuracies and omissions

Occasionally, typographical errors, inaccuracies or omissions may occur in the information on the Services, relating to descriptions, prices, promotions, shipping, lead times and availability. We reserve the right to correct such errors and to change or update information, or even cancel orders, when the information is incorrect, at any time and without prior notice, including after the order has been submitted.

19. Prohibited uses

You may access and use the Services only for lawful purposes. It is prohibited to use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate applicable laws and regulations; (c) to infringe our or third parties' intellectual property rights; (d) to harass, abuse, offend, defame or harm any person; (e) to transmit false or misleading information; (f) to send spam, chain letters or unsolicited promotional material; (g) to impersonate another person or entity; or (h) for any conduct that impairs the use of the Services by others.

You also agree not to: (a) transmit viruses or malicious code; (b) reproduce, copy, sell or exploit any part of the Services without authorization; (c) collect personal data from third parties; (d) use robots, spiders or scraping; or (e) interfere with the security mechanisms of the Services. We may suspend or terminate access at any time if we identify a violation of these Terms.

20. Disclaimer of warranties regarding third-party information and tools

The information provided in the Services is general and informational in nature. We do not guarantee the accuracy, completeness or usefulness of general information, nor the uninterrupted, timely or error-free operation of third-party tools, which are provided "as is".

This disclaimer does not affect the legal warranty of the products nor any rights ensured to the consumer by the Consumer Protection Code, which remain fully preserved.

21. Limitation of liability

To the maximum extent permitted by applicable law, and except for the rights and warranties ensured to the consumer by the Consumer Protection Code, Cabo Eletro will not be liable for indirect, incidental or consequential damages, such as lost profits or loss of data, arising from the use of the Services or of third-party tools.

No provision of these Terms excludes or limits liabilities that, by law, cannot be excluded or limited.

22. Indemnification

You agree to indemnify and hold harmless Cabo Eletro and its partners, officers, employees and service providers from any losses, damages or third-party claims arising from: (1) breach of these Terms; (2) violation of law or third-party rights; or (3) misuse of the Services, subject to applicable law.

23. Suspension and termination of access

We may suspend or terminate access to the Services, in whole or in part, in the event of a violation of these Terms, with you remaining responsible for amounts due up to the date of termination. The clauses that, by their nature, must remain in effect (such as Intellectual Property, Limitation of Liability, Indemnification and Jurisdiction) survive termination.

24. General provisions

• Severability: if any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force.
• Waiver and entire agreement: our failure to enforce any right or provision does not constitute a waiver. These Terms, together with the referenced policies, constitute the entire agreement between you and Cabo Eletro.
• Assignment: you may not assign or transfer these Terms without our prior written consent. Cabo Eletro may assign its rights and obligations upon notice.
• Headings: section headings are for information only and do not limit the content of the clauses.

25. Changes to these terms

Cabo Eletro may update these Terms at any time. The version in effect is always the one published on this page, with the respective update date. It is the customer's responsibility to consult this page periodically. Continued use of the Services after the publication of changes represents acceptance of the changes.

26. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the district of Belo Horizonte/MG are elected to settle any disputes, except where applicable legal provisions for consumer relations state otherwise.
